Equipco Ireland – Terms & Conditions

These Terms and Conditions (“Terms”) apply to all quotations, sales, deliveries, installations, services, and related activities carried out by Equipco Ireland (“Equipco”, “we”, “us”, “our”). By placing an order, accepting a quotation, or receiving goods or services, the customer (“Customer”, “you”) accepts these Terms.
1. Definitions
- Goods: Any equipment, machinery, parts, or materials supplied by Equipco.
- Services: Installation, maintenance, commissioning, repairs, or other work performed by Equipco.
- Order: Any request, purchase, or acceptance of a quotation for Goods or Services.
- Contract: The agreement formed when the Customer accepts a quotation or receives Goods or Services from Equipco.
2. Quotations & Orders
2.1. All quotations are valid for the period stated, or 30 days if no period is specified.
2.2. By accepting a quotation, you agree to these Terms in full.
2.3. Any changes to specification, scope, or requirements must be agreed in writing and may affect pricing, lead times, or installation schedules.
3. Deposits & Payment
3.1. Deposits are non-refundable for goods made to order, custom products, or for stock reserved on your behalf.
3.2. Goods will not be released for collection or delivery until payment is made in full unless otherwise agreed in writing.
3.3. Invoices are payable within the timeframe stated on the invoice.
3.4. Interest may be charged on overdue accounts in accordance with the European Communities (Late Payment in Commercial Transactions) Regulations.
3.5. Equipco reserves the right to recover all reasonable costs associated with debt collection.
4. Retention of Title
4.1. All goods remain the property of Equipco until all payments due have been received in full.
4.2. Risk in the goods passes to the Customer upon delivery or collection.
4.3. The Customer is responsible for insuring goods once delivered, even if title has not yet passed.
5. Delivery, Collection & Installation
5.1. Delivery or installation dates provided are estimates and may change due to supplier delays, transport issues, or site conditions.
5.2. The Customer must ensure clear access, safe working conditions, and compliance with all health and safety requirements at the installation site.
5.3. Any delays caused by inadequate site readiness, lack of access, induction requirements, or unsafe conditions will be chargeable at standard labour rates.
5.4. Plant hire, such as forklifts or MEWPs, is not included in installation quotations unless expressly stated.
5.5. Additional hours required for site induction, wait times, or access delays will be charged at standard labour rates. This includes induction training or requirements such as clean van policy and additonal hours to access site
6. Warranty
6.1. Warranty terms vary depending on the product. Customers must confirm the warranty details at the time of purchase.
6.2. Where goods are not installed by Equipco, a parts-only warranty applies.
6.3. Warranty claims require a completed warranty form and supporting images.
6.4. Warranty does not cover misuse, improper installation, neglect, overloading, lack of maintenance, unauthorised repairs, or failure to follow the user manual.
6.5. Travel and labour charges may apply for warranty inspections unless the fault is confirmed to be covered by warranty.
7. Returns & Faults
7.1. Any discrepancies or damage must be reported within 48 hours of delivery or collection.
7.2. Returns are only accepted for faulty goods when new and only if used in accordance with the user manual.
7.3. Returns of unused goods may be considered at Equipco’s discretion. If accepted, restocking, repackaging, and transport fees will apply.
7.4. Goods must be returned in original packaging and in “as new” condition.
8. Services, Call-Outs & Labour
8.1. Minimum call-out fees apply and vary based on travel distance and time.
8.2. If during a call-out it is found that the issue is not covered by warranty, standard labour and travel charges will apply.
8.3. Any additional works outside the agreed quotation will be chargeable.
9. Customer Responsibilities
9.1. The Customer must ensure that equipment is used strictly in accordance with the manufacturer’s instructions and all applicable safety guidelines.
9.2. The Customer is responsible for compliance with all local, fire, electrical, structural, and health & safety requirements.
9.3. Equipco shall not be liable for delays or failures caused by conditions outside our control, including lack of power, access restrictions, unsafe working areas, or construction delays.
10. Indemnity & Limitation of Liability
10.1. Equipco shall not be liable for any loss, damage, injury, or expense arising from the installation, use, or maintenance of equipment supplied or installed by Equipco, except to the extent required by applicable law.
10.2. The Customer agrees to indemnify and hold Equipco, its employees, and contractors harmless against all claims, liabilities, or costs resulting from improper use, modification, or failure to follow operating or safety instructions.
10.3. Equipco is not liable for indirect or consequential losses, including loss of production, business interruption, or loss of profit.
10.4. Except where prohibited by law, Equipco’s total liability shall not exceed the value of the contract.
11. Force Majeure
Equipco shall not be liable for delays or failure to perform due to events beyond its reasonable control, including supplier delays, transport issues, strikes, labour shortages, extreme weather, accidents, or acts of God.
12. Data Protection (GDPR)
12.1. Equipco processes personal data only for order fulfilment, warranty administration, service provision, and account management.
12.2. All data is handled in accordance with the General Data Protection Regulation (GDPR) and Irish data protection law.
12.3. Customer data is not shared with third parties except where required for delivery, warranty, or legal compliance.
13. Cancellations
13.1. Orders for made-to-order goods cannot be cancelled once confirmed.
13.2. Cancellations of standard goods may incur restocking or administration fees.
13.3. Installation cancellations within 48 hours may incur call-out or labour charges.
14. Subcontracting
Equipco reserves the right to use qualified subcontractors for the supply, delivery, or installation of goods or services.
15. Governing Law
These Terms are governed by the laws of Ireland, and any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
16. Acceptance of Terms
By placing an order, accepting a quotation, or receiving goods or services from Equipco, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
